Yupi Health Terms of Use
Effective date: October 14, 2026
These Terms of Use apply to yupi.health, Yupi Health email content, and free materials that Yupi Health makes available through the site. By using the site or downloading a free Yupi resource, you agree to these Terms. If you do not agree, do not use the site or download the material.
Paid services have separate terms. The First Read Refund Policy and Terms and the Sharp Again client agreement control those services.

In these Terms, "Yupi," "Yupi Health," "we," and "us" mean Yupi LLC.
Adults in the United States only
The site and its materials are intended for adults who are at least 18 years old and located in the United States. We do not knowingly offer the site or collect information from anyone under 18.
The site and its offers are not directed to people outside the United States. Availability may also vary by state. An offer page or client agreement may list additional location rules.
Educational information, not medical care
Yupi provides health-coaching services and educational information through a Functional Diagnostic Nutrition lens. Public website and email content is for general education. It is not medical advice, diagnosis, treatment, or a substitute for care from a licensed medical provider.
Franko Morales is a Functional Diagnostic Nutrition Practitioner. He is not a licensed physician. Using the public site, reading an email, or downloading a free guide does not create a physician-patient relationship or a coaching relationship with Yupi or Franko.
Do not use the site to decide whether to start, stop, or change prescribed medication or medical treatment. Speak with your licensed medical provider before changing your diet, supplements, exercise, or healthcare plan, especially if you have a diagnosed condition, are pregnant, are breastfeeding, or take prescribed medication.
The site is not an emergency service. Call 911 or the appropriate emergency service if you believe you have a medical emergency.
No promised result
Health information must be considered in context, and people respond differently to food, habits, supplements, coaching, and other changes. Yupi does not promise that website content, an email, or a free guide will produce a particular health result.
We review the health claims we publish, and we change any claim that we cannot support.
Separate terms for services and purchases
These Terms govern the public site, free downloads, and email content. They do not set the price, refund rights, service details, or cancellation rules for a paid offer.
The First Read is governed by the First Read Refund Policy and Terms. Sharp Again is governed by the client agreement provided during enrollment. Other paid services or programs may have their own checkout terms or client agreement.
If these Terms conflict with the separate terms for a paid service, the separate terms control for that service. A sales page, checkout, consent form, and service agreement should say the same thing. If you see a difference, contact us before you pay.
Free guides and email content
You may use a Yupi guide for your own personal, noncommercial use. You may read, watch, listen to, save and print one copy of a guide for yourself. You may not sell it, publish it, upload it to another site, use it in a course or client service, remove its notices, or distribute copies without written permission from Yupi.
Asking for a guide, or joining the First Read waitlist, also joins you to the Yupi newsletter. The newsletter may include educational content and promotions. You can unsubscribe from marketing email through the link in any marketing message. Unsubscribing from marketing does not stop messages needed to complete a purchase or provide a service you requested.
Email content is subject to the same educational and medical boundaries as the public site.
Ownership and permitted use
Unless a page says otherwise, Yupi owns the text, guides, graphics, page design, videos, audio, downloads, and other original material it publishes. Names, logos, and marks may also be protected by trademark or other law.
Yupi gives you a limited, personal, nonexclusive, nontransferable, revocable permission to view the site and use its free materials as these Terms allow. This permission does not transfer ownership.
You may share a normal link to a public Yupi page. You may not copy a page or guide and present it as your own, create a competing product from it, train an artificial-intelligence model on it, or use automated tools to extract or reproduce substantial portions of the site without written permission.
Yupi does not currently identify third-party licensed material within the content covered by these Terms. If that changes, the relevant credit, license, or use restriction will appear with the material and will control its use.
Prohibited uses
You may not use the site or its materials to:
- break a law or encourage someone else to break a law;
- impersonate another person or submit information you are not authorized to provide;
- interfere with the site, test it for vulnerabilities without permission, bypass an access control, or introduce harmful code;
- scrape, harvest, or collect information through automated means without written permission;
- copy, resell, sublicense, or commercially exploit Yupi material outside the permission stated above;
- make a false or misleading statement about Yupi, Franko, or the source of Yupi content;
- send spam, threats, harassment, or unlawful material; or
- use Yupi content as medical advice or present it as a diagnosis or prescription for another person.
We may restrict access when we reasonably believe a person is misusing the site.
Forms and information you send
The site may include guide, newsletter, contact, state-check, waitlist, checkout, appointment, quiz, survey, and client-intake forms. Give accurate information and use the form for its stated purpose.
Yupi does not provide a public comment board, chat room, or other feature for publishing visitor content. Information sent through private forms is handled under the Yupi Health Privacy Policy and, when applicable, the separate agreement for the service.
Do not send detailed health records through a general contact form. Use the intake or client portal designated for the service.
Third-party services and links
The site may link to a laboratory, supplement platform, payment provider, scheduling service, video platform, or other third party. A link does not make Yupi responsible for that third party's site, security, availability, terms, privacy practices, or products. Review the third party's terms and privacy notice before using its service.
Yupi may sometimes earn a commission or receive another benefit when you use a link. When a material relationship exists, Yupi will disclose it clearly near the recommendation or link. You remain free to buy elsewhere unless the separate service terms state that a specific provider is required for fulfillment.
Today, the only identified relationship of this kind is the Fullscript relationship described in the separate First Read Terms. These site-wide Terms do not identify any other affiliate relationship.
Site availability, changes, and errors
We may update, suspend, or remove site content. We do not promise that every page, download, or link will always be available or error-free.
We try to keep public information accurate. If a page contains a price, availability rule, or service detail that conflicts with the checkout or separate offer agreement, stop and contact us before buying. Yupi may correct an error, but a correction does not reduce a right you already have under applicable law or a separate agreement.
Disclaimer of warranties
To the extent permitted by law, the public site, free materials, and email content are provided "as is" and "as available." Yupi does not make warranties about uninterrupted access, error-free operation, or fitness for a particular purpose. Nothing in this section disclaims a warranty or consumer right that cannot legally be disclaimed.
Limitation of liability
To the extent permitted by law, Yupi LLC and its owner will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the public site, free materials, or email content. This section does not limit liability that cannot legally be limited, and it does not replace the liability terms in a separate service agreement.
Governing law and disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any court proceeding concerning these Terms will take place in the state or federal courts located in King County, Washington, unless applicable law requires another location.
Changes to these Terms
We may update these Terms when the site, services, or law changes. The effective date at the top shows when the current version began. Changes apply after the revised Terms are posted. A separate offer agreement explains how changes to that agreement work.
Severability and waiver
If a court finds part of these Terms unenforceable, the remaining parts stay in effect to the extent the law permits. If Yupi does not enforce a provision once, that does not waive the right to enforce it later.
